SALARY RANGE : $140,000 - $155,000

HOURS OF WORK : 8am-4:30 pm or 9am-5:30pm (7 ½ hours)

This position is eligible for telework which is currently one day per week. New hires are eligible to apply 30 days after their effective date of hire.

SUMMARY :

This position manages, develops, implements, and enforces collective bargaining provisions, NYC Transit policies and programs relative to employee availability and labor cost control, including overseeing audits and investigation of sick abuse and fraud, theft of time, and chronic absenteeism, as well as initiate related disciplinary action. The incumbent also analyzes and tracks employee availability trends, including creating performance metrics to measure progress, identifies vulnerabilities in absentee control monitoring, designing strategic improvement plans and initiatives, as well as prepares related presentation for senior management and staff. Incumbent also provides advice and counsel to senior management, their staff, and the Office of Labor Relations team on implementation of employee availability programs. Oversees compliance of Family and Medical Leave Act (FMLA), NYS Paid Family Leave (PFL), Americans with Disabilities Act (ADA) and other federal and state laws as relating to employee availability, as well as ensure that Agency leave management programs are congruent with such laws and regulations. Works with MTA Agencies and senior management on strategic plans to improve employee availability. Prepares and conduct training to Agency staff on improving employee availability and absentee control enforcement, as well as implements best practices on improving employee availability. Provides assistance/guidance to Labor Counsels/Attorneys and Hearing Officers in the preparation and presentation of employee availability discipline and contract interpretation grievances. Answers/responds to correspondences relating to employee availability, FMLA and PFL.

RESPONSIBILITIES :

  • Implements and enforces NYC Transit policies and collectively bargained agreements and programs relative to employee availability and cost control, as well as analyzes and tracks employee availability trends, identifies vulnerabilities in absentee control monitoring, provide metrics and reporting on findings, and designs strategic availability improvement plans and initiatives.

  • Manages and directs audits and investigations of sick abuse and fraud, theft of time and chronic absenteeism, in accordance with relevant collective bargaining agreements, as well as provide administrative oversight of collectively bargained availability programs. May also oversee investigations and/or audits of Agency overtime abuse and theft.

  • Identifies, prepares, and conducts training to Agency personnel on improving the management of employee availability and absentee control enforcement, as well as implementing related best practices. Formulates and delivers training on maintaining good attendance record to new hires and newly promoted supervisors and managers on an on-going basis, as well as create and deliver related training programs to address employee availability to the entire workforce.

  • Liaises with internal senior operating management and support departments (Controller, BSC, MTA-IT, Audit, SIR, SIU, OIG) and external (law enforcement, regulatory agencies, professional accreditation bodies) to ensure compliance with policies, procedures and audit and investigations findings.

  • Provides advice and counsel to senior management, their staff and Office of Labor Relations staff on employee availability management methodologies and techniques to improve internal controls and monitoring processes, as well as prepare and make related presentations.

  • Select, develop, and motivate personnel within the department. Provide career development for subordinates. Provide prompt and effective coaching and counseling. Responsible for discipline/termination of employees when necessary. Review performance of staff. Create a professional environment that respects individual differences and enables all employees to develop and contribute to their full potential.

  • Other duties as assigned.

    KNOWLEDGE, SKILLS, AND ABILITIES

  • Must have extensive knowledge of Employee Availability/Absenteeism Management/Programs and initiatives.

  • Must have knowledge of Family and Medical Leave Act (“FMLA”) and New York Paid Family Leave Act (“NY-PFL”), Americans with Disabilities Act and related City, State and Federal laws/regulations.

  • Extensive knowledge overseeing and/or conducting investigations and audits.

  • Implementation and enforcement of bargaining agreements.

  • Extensive background in training and doing presentations.

  • Excellent communication and interpersonal skills.

  • Excellent organizational and presentation skills.

  • Demonstrated ability to work with all internal levels within a given organization, including the MTA Board.

  • Demonstrated ability to communicate and interact well with external agencies. External agencies may include the Governor’s Office for New York State, New York City government, elected and other public officials, as well as any staff located at other federal or state agencies or authorities.

  • Demonstrated ability to work in a high-profile, high-pressure environment effectively.

  • Demonstrated ability to communicate effectively with key internal and/or external stakeholders.

  • Must have strong managerial skills to effectively direct a staff of professional and technical employees in implementing the short- and long-term goals and direction for the area of responsibility.

  • Demonstrated ability to complete short- and long-term projects effectively and as efficiently as possible.

  • Demonstrated analytical capabilities and quantitative skills.

  • Demonstrated proficiency in Microsoft Office Suite or comparable applications, i.e., Word, Excel, PowerPoint, and Outlook.

    EDUCATION AND EXPERIENCE :

    REQUIRED:

  • Bachelor’s degree in Labor Relations, Law, Business, Transportation, Public Policy/Administration or a related field or an equivalent combination of education and experience may be considered in lieu of a degree.

  • Minimum 10 years related experience, including at least 5 years in a managerial and/or leadership role in a large, multi-faceted, fast-paced organization or governmental body preferred.

    PREFERRED:

  • Juris Doctorate in a related field.

  • Conducting and/or overseeing investigations and audits.

  • Background in training and doing presentations.

  • Familiarity with the MTA’s policies and procedures.

  • Familiarity with the MTA’s collective bargaining procedures.
